He receive a replacement badge with his name and date engraved on the badge. ________________________________________________________________ APPLICANT CONTENDS THAT: He was awarded the Elementary Excellence in Competition Rifleman Badge while he was stationed in Panama, but the badge is not reflected in his records. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: On 8 Jul 75, the applicant commenced his enlistment in the Regular Air Force (RegAF). He retired on 1 Oct 98 and was credited with 23 years, 2 months, and 23 days of active service. Per the news article provided by the applicant he was awarded the Elementary Level Excellence in Competition Bronze Rifle Shot Badge. The remaining relevant facts pertaining to this application are contained in the letters prepared by the appropriate offices of the Air Force, which are attached at Exhibits C and D. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial of the applicant’s request to add the Elementary Excellence in Competition Rifleman Badge to his military records. AFI 36-2903, Dress and Personal Appearance of Air Force Personnel, directs the wear of uniforms, insignias, awards, and decorations; however, the Elementary Excellence in Competition Rifleman Badge is not listed as an authorized item to be worn on the Air Force uniform. A complete copy of the AFPC/DPSIM evaluation is at Exhibit C. AFPC/DPSOR recommends denial to list the Elementary Excellence in Competition Rifleman Badge on the applicant’s DD Form 214. Per the DPSIM advisory, the badge is not authorized for wear on the Air Force uniform and is therefore not authorized to be listed on the DD Form 214. A complete copy of the AFPC/DPSOR evaluation is at Exhibit D. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 14 Aug 13, for review and comment within 30 days. As of this date, no response has been received by this office. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. ________________________________________________________________ ?
